Privacy Policy – Circle Plus Payments

This privacy policy explains how your personal data is used in the Apple Payment Service (Apple Pay). This is in addition to the uses of your personal data described in your account terms and conditions and stripe connect account’s terms and conditions. You should read this alongside the Apple Pay Terms and Conditions.

We collect information about you when you register for and use Apple Pay. This may include your phone number and details of your transactions. Contact and shipping details are also captured for Apple Pay transactions over the internet.

If you register your debit or credit cards for Apple Pay, you agree for your personal and transactional data to be used and shared as set out below.

Using your personal data

You agree that:

Circle Plus Payments inc. US will collect and use your personal data to verify your credit/debit card(s) and to facilitate your use of Apple Pay once you’ve registered your card as a Digital Card. Information about your Digital Card and your latest transactions will be stored on your Apple device so you can make contactless or in-app transactions.

Your information will be used to deal with Apple Pay queries, authorise payments, prevent and detect fraud, comply with legal requirements and industry standards, and to help Circle Plus Payments develop, maintain, and improve our products and services. We’ll use your details to send you service messages about Apple Pay via notifications, email/SMS and post.

Sharing your personal data

You agree that:

Your Digital Card data, and contact and shipping details for Apple Pay in-app transactions can be shared with retailers so they can deal with your transactions.

We may share your personal data with the Circle Plus Payments Group, Circle Plus Payments associated companies, and service providers and agents acting under Circle Plus Payment’s instructions.

Your transactional data may be shared with VISA and MasterCard so they can process the transaction and support the Digital Card provision.

If you’ve switched on location services, Apple (Apple Distribution International and Apple Inc.) may see your locational data. For more information, please see Apple’s Privacy Policy.

Privacy Policy – Android Pay

The Google Privacy Policy describes how we treat personal information when you use Google’s products and services. Google Payments is offered to Google Account holders. Your use of Google Payments is therefore subject to the Google Privacy Policy. In addition, the following notice describes our privacy practices that are specific to Google Payments.
Your use of Google Payments is governed by the Google Payments Terms of Service, which describes in more detail the Services covered by this privacy notice. Capitalized terms not defined in this Google Payments Privacy Notice shall have the meaning ascribed to them in the Google Payments Terms of Service.

The Google Payments Privacy Notice applies to Services offered by Google Inc.’s wholly owned subsidiaries. For US users, that subsidiary is Google Payment Corporation (“GPC”), and for users in the European Economic Area (EEA), it is Google Payment Limited (“GPL”) (based in the United Kingdom). For countries outside of the United States and the EEA, please consult the Google Payments Terms of Service made available to you within the Service to learn the subsidiary offering the Service.

Information we collect

In addition to the information listed in the Google Privacy Policy we may also collect the following:

  • Registration information – When you sign up for Google Payments, you are creating a Google Payments Account that is associated with your Google Account. Depending on the Google Payments services you use, in addition to the information listed in the Google Privacy Policy, you may be asked to provide the following information: Credit or debit card number and card expiration date, bank account number and expiration date, address, phone number, date of birth, social security number or taxpayer identification number (or some other government-issued identification number), and for sellers or businesses specifically, your business category and certain information about your sales or transaction volume. In some cases, we may also ask you to send us additional information or to answer additional questions to help verify your information. Finally, if you register a Carrier Billing Account, we will ask you to provide us with certain information about your mobile telephone account.
  • Information obtained from third parties – We may obtain information about you from third parties, including third party verification services. This includes information arising from Google Payments transactions at merchant locations, information regarding your use of payment methods and your accounts issued by third parties that are linked to the Google Payments, the identity of your card issuer or financial institution, information regarding access to balances held in your Google Payments Account, information from a Carrier in connection with Carrier Billing, and consumer reports, as the term “consumer reports” is defined by the US Fair Credit Reporting Act.
    Also, for sellers, we may obtain information about you and your business from a credit bureau or a business information service.
  • Transaction information – When you use Google Payments to conduct a transaction, we may collect information about the transaction, including: Date, time and amount of the transaction, the merchant’s location and description, a description provided by the seller of the goods or services purchased, any photo you choose to associate with the transaction, the names and email addresses of the seller and buyer (or sender and recipient), the type of payment method used, your description of the reason for the transaction, and the offer associated with the transaction, if any.

How we use the information we collect

In addition to the uses listed in the Google Privacy Policy, we use the information you provide us, as well as information about you from third parties, in order to provide you with Google Payments for customer service purposes, and to protect you from fraud, phishing or other misconduct. Such information may also be used to assist third parties in the provision of products or services that you request from them. We also use the information to review your Google Payments Account to determine whether you continue to meet the terms of the account, to make decisions about your future Google Payments transactions, and for other legitimate business needs related to the Google Payments transactions initiated by you.

Your registration information is stored in association with your Google Account and your registration of a payment method will be stored on Google’s servers. In addition, certain data elements may also be stored on your mobile device.

Information we share

We will only share your personal information with other companies or individuals outside of Google in the following circumstances:

  • As permitted under the Google Privacy Policy.
  • As necessary to process your transaction and maintain your account.
  • To complete your registration for a service provided by a third party.

For example, when you make a purchase or transaction using Google Payments, we make certain personal information about you available to the company or individual you purchase from or transact with. This includes sharing your personal information with the developer from whom you purchased when you use Google Payments to make a purchase on Google Play.

Any information you provide directly to a third party merchant, website or application is not covered by this privacy notice. We are not responsible for the privacy or security practices of merchants or other third parties with whom you choose to share your personal information directly. We encourage you to review the privacy policies of any third party to whom you choose to share your personal information directly.

The information that we collect, including information obtained from third parties, is shared with our affiliates, meaning other companies owned and controlled by Google Inc. Our affiliates, which can befinancial and nonfinancial entities, will use such information for their everyday business purposes.

We provide you with the right to opt out of certain sharing between GPC and its affiliates. Specifically, you may choose to opt out of:

  • Sharing between GPC and its affiliates of information about your creditworthiness for their everyday business purposes; and/or,
  • Our affiliates marketing their products or services to you based on your personal information that we collect and share with them. This information includes your account history with us.

If you choose to opt out, your choice will be effective until you tell us to change your choice.

If you don’t want us to share personal information about your creditworthiness between GPC and its affiliates or if you do not want our affiliates to use your personal information collected by us and shared with them to market to you, please indicate your preference by logging into your account, going to the Google Payments privacy settings page, and updating your preferences.

We will not share your personal information with anyone outside of GPC or with our affiliates except as described in this privacy notice. As explained above, Google Payments is a product offered to Google Account holders. Data you provide to Google Inc. for the purpose of signing up for a Google Account is not affected by the opt-out provisions in this notice.

The security of your Google Payments Account depends on you keeping your account password(s), PINs, and other access information for the Service confidential. If you share your account information with a third party, he or she will have access to your account and your personal information.

It is your responsibility to control access to your mobile device and the Google Payments application on your device, including keeping your password(s) and/or PIN confidential and not sharing it with anyone. It is also your responsibility to alert Google or the relevant partner if you believe that the security of the information in the Google Payments application has been compromised.

Privacy Policy- Apple Pay

Apple Pay protects your personal information, transaction data, and credit, debit, and prepaid card information with industry-leading security. Learn more about Apple Pay security and privacy below.

When you pay using Apple Pay within apps or on the web

To securely transmit your payment information when you pay in apps and on the web, Apple Pay receives your encrypted transaction and re-encrypts it with a developer-specific key before the transaction information is sent to the developer or payment processor. This key helps ensure that only the app or website you’re purchasing from can access your encrypted payment information. Every website offering Apple Pay must also verify their domain every time Apple Pay is offered as a payment option. As with in-store payments, Apple sends your Device Account Number to the app or website along with the dynamic security code. So neither Apple nor your device sends your actual credit, debit, or prepaid card numbers to the app.
When you use Apple Pay on your iPhone or Apple Watch to confirm a purchase from your Mac in Safari,* Apple Pay transfers purchase information in an encrypted format between your Mac and your iOS device or Apple Watch to complete your transaction. You can disable the ability to pay on your Mac with Apple Pay by going to Settings > Wallet & Apple Pay and disabling Allow Payments On Mac on your iPhone.
Apple Pay retains anonymous transaction information including the approximate purchase amount, app developer and app name, approximate date and time, and if the transaction completed successfully. Apple uses this data to improve Apple Pay and other products and services. Apple also requires apps and websites in Safari using Apple Pay to have a privacy policy that you can view which governs their use of your data.
For your convenience, when using an app or a website that uses Apple Pay in iOS, watchOS, or macOS the app or website can check if you have Apple Pay-enabled on that device. This can be managed in Settings.

When you add and use rewards cards with Apple Pay transactions in stores

When you add rewards cards to Wallet, all the information is stored on your device and encrypted with your passcode. iCloud can be used to back up your cards and keep your rewards cards up-to-date on multiple devices. iCloud secures your data by encrypting it when it’s sent over the Internet and storing it in an encrypted format when kept on Apple’s servers. You can disable iCloud support on your device by going to Settings > [your name] > iCloud and turning off Wallet. Learn more about how iCloud stores and protects your data.
You can choose to have a rewards card automatically presented for use in the merchant’s stores when you make an Apple Pay purchase. You can disable automatic selection of a rewards card by changing its setting in Wallet. Any time personally identifiable information is sent to the payment terminal when you use your rewards cards — like your email or phone number — we require the merchant to encrypt the data. And no rewards card information is sent without your authorization.

If you lose your device and need to suspend or remove cards from Apple Pay

If you turned on Find My iPhone on your iPhone, iPad, Apple Watch, or a MacBook Pro with Touch ID, you can simply suspend Apple Pay by placing your device in Lost Mode using Find My iPhone instead of immediately canceling your cards. You can also permanently remove the ability to pay with Apple Pay using the credit, debit, and prepaid cards on your device and attempt to remove the rewards cards stored on your device by erasing the device remotely using Find My iPhone. On iPhone, iPad, Apple Watch, and a MacBook Pro with Touch ID, you can go to your Apple ID account page to remove the ability to make payments from cards on the device.

Your credit, debit, and prepaid cards will be suspended or removed from Apple Pay by your bank, your bank’s authorized service provider, your card issuer, or your issuer’s authorized service provider, even if your device is offline and not connected to a cellular or Wi-Fi network. You can also call your bank or issuer to suspend or remove your credit, debit, or prepaid cards from Apple Pay.

Suica cards can’t be suspended if your device is offline. You can remove your Suica cards by erasing your device remotely on Find My iPhone or removing all cards from your Apple ID account page. If your device is offline when you try to erase it, your Suica cards might still be available for use at some terminals until 12:01 AM JST the following day. If you remove your Suica cards, the balance is recoverable. You can add them back to a device signed in with the same Apple ID after 5:00 AM JST the following day.

Changes to this Policy

This policy may change from time to time and any revised Policy will be posted on this page, so we encourage you to review it regularly. If we make changes, we will notify you by revising the date at the top of this Policy and, in the case of materials changes to the Policy, we may provide you with additional notice (such as a notice in our user interface or sending you a notification by email).
